CAN AN EMPLOYEE REJECT SACK LETTER?

Hello Jarus,

Trust you had a great day?

I work in one of the outsourced  call centres in the country. In November, we woke up one day to the dismissal of some members of staff.

They were just called into the an office, handed dismissal letters, asked to sign that they have received  the letters, submit IDs & other work tools, and asked to leave the premises at once. We hear there would be more casualties this December so everyone is scared.

It’s not like the job pays much anyway (less than 70k) but most of us feel it’s better than nothing and we have been there for over 3 years.

Now these are my questions:

1. Can such employees who were laid off for no reason refer to this company on their CV? If you tell a prospective employer that you were sacked from your previous job, won’t that reduce your chances?

2. Can a sacked employee reject a sack letter. I ask because I plan to do that if am affected by the December dismissal. I feel I will just ask for a pen & paper and write my resignation  letter on the spot.

Do you think this is practicable? What are the consequences of getting sacked?

Dear Ebenezer,

1, People have been dismissed from job before and got better jobs. People get dismissed every now and then. It doesn’t mean you should not include it on your CV. If asked in subsequent interview why you left your former employer, tell them there was a massive downsize and you were affected. It’s no big deal, especially if you do well in the interview.
2, Rejecting a letter of disengagement depends on the contract you signed with them. What does your contract say on termination? If it says you can be sacked at anytime, there is nothing you could do. If it says, they must give you notice, then you have a case.

    Good day Jarus,

    I was recently given a notice of non confirmation of employment spending only 3months there. My concern is can I include it on my CV especially it been a career I really want to build.

    It came as a shock to me especially where I am seen by the majority as a top performer.

    Would it affect my job chances?

      Unfortunately, how your fellow employees see you may be different from how decision makers see you.

      Put it on your CV. If asked during interview why you quit after 3 months, just play with words. Something like “It’s a good company I would have loved to stay longer with as I was learning. There was some restructuring in the company that affected me and a couple of others. Nonetheless, I learnt from the experience”.
